Fiduciary Origin Determination Subcommittee Releases Fourteen-Page Memo Clarifying That A Person Who Did Not Earn The Money Is Not The Person Who Earned The Money, Describes Finding As 'Genealogically Unambiguous'

MEMORANDUM — FOR IMMEDIATE DISTRIBUTION ISSUING BODY: Office of Estate Source Attribution and Intergenerational Funds Designation (OESAIFD) SUBJECT: Preliminary Determination Regarding the Grandfather-Origin Status of Funds Previously Held in Trust by a Person Currently Subject to a Statute CLASSIFICATION: Routine / Do Not Escalate Until We Determine Whether It Needs Escalating

The Office of Estate Source Attribution and Intergenerational Funds Designation has, following a seventeen-month procedural review, issued a preliminary non-binding determination that money which originated with a grandfather did originate with a grandfather, and has not, at any subsequent point, re-originated with a different person.

"The funds in question trace backward through established genealogical and financial channels to a grandfather," read the memo, dated this Tuesday. "That grandfather was, at time of origination, alive, and the funds were, at that time, his. Both of these facts have been corroborated by records and also by the general passage of time."

The office stressed that the determination addresses only the origin of the funds, and does not constitute an opinion on what the funds have been doing since, where the funds currently are emotionally, or whether the funds have any awareness of the statute.

"The statute, for its part, remains a statute," the memo continued. "Its applicability to funds of grandfather origin is a separate question which this office is not currently authorized to answer, but which we have flagged for a subcommittee that has been notified and is aware it has been flagged."

A supplementary addendum, appended on page eleven, clarified that the grandfather in question was a "Hollywood legend," a designation the office confirmed was "entertainment-sector in nature and not a legal classification under current trust law, though we are monitoring the situation."

The addendum further noted that the Hollywood legend had, prior to the funds becoming trust funds, been a person in possession of the funds, and that this possession had since concluded in the customary manner.

"We wish to be clear," the memo stated in its closing paragraph, "that the office is not determining guilt, innocence, statutory applicability, fund eligibility, grandfather intent, or the moral valence of any party. We are determining origin. The origin is the grandfather. This finding is complete. A follow-up memo will be issued to confirm that this memo was issued."

At press time, the subcommittee that was flagged had convened a preliminary session to determine whether the flag was the kind of flag that required a response or the kind that required acknowledgment of the flag, and had tabled the distinction pending further flagging.
